As per the Foreign Exchange Management Act, 1999, a Non-resident Indian is:
Any Indian citizen who stays out of the country, be it for the purpose of employment or business or holiday or for any other reason in situations or instances that indicate an indefinite time (period) of stay abroad; OR,
Government employees who are officially posted in a foreign land on duty with the Indian Mission and with any other agencies that are set up overseas by the India Government. Here, the officers get salaries from Government resources; OR,
Government officials appointed overseas on an assignment with any foreign government or regional/international organizations such as the World Health Organization (WHO), Economic and Social Commission for Asia and the Pacific (ESCAP); OR,
Officer of the State Government and/or Public Sector Undertakings appointed in a foreign country on temporary basis or appointed to a branch or office overseas.
